Notice of Opportunity to Comment on Revisions to 6 CCR 1007-3, Part 267, Subpart Q
Background:
In accordance with Colorado House Bill 22-1345 and Title 25, Article 5, Part 13 of the Colorado Revised Statutes, the Colorado Department of Public Health and Environment will be revising Part 267, Subpart Q, of the Colorado Hazardous Waste Regulations concerning measures to increase protections from perfluoroalkyl and polyfluoroalkyl substances, also referred to as PFAS, used in Class B firefighting foam.
The revisions will involve updates to the existing regulatory language, and expand the applicability of use restrictions, additional reporting requirements, capture requirements, and storage requirements for persons who use one or more gallons of Class B firefighting foam containing intentionally added PFAS as required by Title 25, Article 5, Part 13 of the Colorado Revised Statutes.
The Hazardous Materials & Waste Management Division is holding an initial stakeholder meeting on Wednesday, October 4, 2023, from 09:00 AM to 10:30 AM, to be held online using Zoom. Guests may register for the meeting using this link:

The purpose of the meeting is to: a) discuss the relevant statutory requirements established by House Bill 22-1345; b) provide an overview of the proposed revisions to the existing regulations; and c) discuss the revisions and gather feedback from stakeholders. The Department will consider all comments prior to presenting proposed revisions to Part 267, Subpart Q, to the Solid and Hazardous Waste Commission for consideration. Interested stakeholders are encouraged to review the proposed revisions to Part 267, Subpart Q, of the Colorado Hazardous Waste Regulations, provided as a .pdf attachment to this notification, prior to the stakeholder meeting.
In the event additional time is necessary to adequately address all questions, comments, or concerns following the initial stakeholder meeting, a second stakeholder meeting is tentatively scheduled for November 1, 2023 from 10:30 AM to 12:30 PM, to be held online using Zoom. Additional details regarding the status of the stakeholder process, including registration for the second stakeholder meeting, will be communicated in subsequent emails as necessary.
